The Ministry of Home Affairs has notified1 the Foreign Contribution (Regulation) Amendment Rules, 2026 (Amended Rules), which came into force on the date of their publication in the Official Gazette. The Amended Rules introduce significant changes to the Foreign Contribution (Regulation) Rules, 2011 (FCRA Rules), with the objective of strengthening the regulatory framework governing the receipt and utilisation of foreign contribution (FC) in India.
The amendments, inter alia, introduce a statutory definition of ‘Key Functionary’, a purpose-specific and geography-specific registration framework, a prescribed schedule of eligible registration purposes, an objective benchmark for assessing ‘reasonable activity’ in renewal and cancellation proceedings, enhanced reporting and disclosure requirements, and revised as well as newly prescribed statutory forms.
